1. About Inmedialy

Inmedialy provides digital services to businesses and professionals.

  • other services agreed upon with the client.

The exact services included in your subscription or project are those presented at the time of purchase or agreed upon separately between Inmedialy and the client.

2. Our Services

Inmedialy offers digital services designed to help businesses manage and improve their online presence without having to hire a full-time internal digital team.

Depending on the selected offer, the service may include access to a dedicated graphic designer, developer, or other digital resources.

The services included in each plan are described on our website or in the agreement provided to the client before the subscription begins.

Inmedialy reserves the right to improve, modify, or update its services when necessary, provided that such changes do not substantially reduce the services already agreed upon with the client.

3. Subscription and Pricing

The price of the Inmedialy subscription is displayed on our website or communicated to the client before the subscription is confirmed.

Where applicable, the current subscription price is:

€350 per month

The applicable price, taxes, payment frequency, and services included are those confirmed at the time of subscription.

Prices may be changed in the future. If a price change affects an existing subscription, Inmedialy will inform the client in advance and the new price will only apply according to the applicable contractual terms.

All prices and any applicable taxes or additional charges will be communicated clearly before the client confirms the purchase.

4. Payment

Payment must be made using the payment method made available by Inmedialy.

For recurring subscriptions, the client authorizes the applicable payment provider to charge the agreed amount according to the billing schedule.

If a payment fails, Inmedialy may contact the client to request an updated payment method or payment of the outstanding amount.

Inmedialy may temporarily suspend services if an invoice or subscription payment remains unpaid.

Services may resume once the outstanding payment has been received, subject to any applicable conditions.

5. Starting the Service

Once the subscription or service has been confirmed and payment has been successfully received, Inmedialy will begin the onboarding process.

The client may be asked to provide information, files, brand assets, access credentials, instructions, or other materials necessary to perform the services.

Delays caused by missing information, inaccessible accounts, late approvals, or other circumstances outside Inmedialy’s reasonable control may affect the delivery schedule.

6. Client Responsibilities

To provide the services efficiently, the client agrees to provide accurate and useful information and to cooperate with Inmedialy when necessary.

The client is responsible for:

  • providing accurate project information;

  • providing the necessary files and brand assets;

  • providing access to relevant platforms when required;

  • giving clear instructions and feedback;

  • reviewing and approving delivered work within a reasonable timeframe;

  • ensuring that any materials supplied to Inmedialy may legally be used for the requested project.

The client must not provide content or materials that infringe the rights of another person or organization.

7. Requests and Deliverables

The services provided by Inmedialy may involve recurring requests and deliverables throughout the subscription period.

The exact number and type of deliverables depend on the selected offer and the scope agreed with the client.

Inmedialy will make reasonable efforts to complete requests within an appropriate timeframe. Delivery times may vary depending on the complexity of the request, the number of requests being processed, client feedback, and other project requirements.

A subscription does not guarantee that every request will be completed immediately or simultaneously.

Inmedialy may prioritize requests according to urgency, complexity, dependencies, and available production capacity.

8. Revisions and Client Feedback

Inmedialy aims to deliver work that meets the client’s brief and expectations.

When revisions are reasonably required to align a deliverable with the original brief, the client may request adjustments within the scope of the service.

Requests that substantially change the original brief or require a completely new concept may be treated as a new request or additional service.

The client is responsible for providing clear and timely feedback so that the project can move forward efficiently.

9. Third-Party Services

Some Inmedialy services may rely on third-party services, platforms, software, hosting providers, payment providers, APIs, or other external technologies.

Inmedialy does not control the availability, pricing, security, or functionality of third-party services.

If a third-party service becomes unavailable, changes its terms, experiences an outage, or modifies its functionality, Inmedialy will make reasonable efforts to find an appropriate solution where possible.

However, Inmedialy cannot guarantee the continuous availability of services that depend entirely on third-party providers.

10. Website Hosting and Maintenance

Where hosting or website maintenance is included in the client’s plan, the exact scope of these services will be defined by the applicable offer or agreement.

Maintenance may include updates, technical adjustments, performance improvements, monitoring, or other website-related tasks.

Hosting and maintenance do not guarantee that a website will be permanently free from technical issues, interruptions, security incidents, or third-party service failures.

Inmedialy will make reasonable efforts to maintain the website and resolve issues within its control.

11. Intellectual Property

Unless otherwise agreed in writing, Inmedialy retains ownership of its pre-existing tools, methods, templates, systems, know-how, processes, code libraries, and other materials developed independently of a specific client project.

For work specifically created for the client, the rights granted or transferred to the client will depend on the applicable agreement and on whether all required payments have been completed.

The client remains responsible for ensuring that materials provided to Inmedialy, including images, logos, fonts, videos, text, or other content, may legally be used.

Inmedialy may use publicly available work created for a client as part of its portfolio or promotional materials unless the client and Inmedialy have agreed otherwise in writing.

12. Confidentiality

Inmedialy understands that clients may share confidential information during a project.

We will make reasonable efforts to keep confidential information private and will not intentionally disclose it to third parties unless:

  • the client has authorized the disclosure;

  • disclosure is necessary to provide the requested service;

  • disclosure is required by law; or

  • disclosure is necessary to protect the rights or security of Inmedialy or another person.

13. Acceptable Use

You agree not to use Inmedialy’s website or services to:

  • violate applicable laws or regulations;

  • distribute malicious software or harmful code;

  • infringe intellectual property or other rights;

  • engage in fraudulent or deceptive activities;

  • attempt to gain unauthorized access to systems or accounts;

  • upload or distribute illegal, abusive, defamatory, or harmful content;

Inmedialy may suspend or terminate access to its services where there is a serious or repeated violation of these Terms and Conditions.

Inmedialy may suspend or terminate a subscription in cases including:

  • unpaid invoices;

  • serious violation of these Terms and Conditions;

  • fraudulent activity;

  • abusive behavior;

  • misuse of the services.

Where appropriate, Inmedialy will provide reasonable notice before termination.

15. Limitation of Liability

Inmedialy will make reasonable efforts to provide reliable and professional services.

However, we cannot guarantee that the website, hosting, software, third-party services, or other digital systems used in connection with our services will always be available, uninterrupted, or completely free of errors.

To the extent permitted by applicable law, Inmedialy will not be responsible for losses resulting from:

  • third-party service failures;

  • internet or network interruptions;

  • unauthorized access caused by compromised client credentials;

  • inaccurate information supplied by the client;

  • delays caused by missing client information or approvals;

  • events outside Inmedialy’s reasonable control.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

16. Force Majeure

Inmedialy will not be considered responsible for a failure or delay caused by circumstances beyond its reasonable control.

These circumstances may include natural disasters, major infrastructure failures, widespread internet outages, cyber incidents affecting essential third-party infrastructure, government actions, or other events that could not reasonably have been prevented.

In such circumstances, Inmedialy will make reasonable efforts to restore or continue the affected services as soon as possible.

17. Changes to These Terms

Inmedialy may update these Terms and Conditions when necessary, for example when our services, business practices, or legal obligations change.

When significant changes affect an existing client relationship, we will provide appropriate notice where required.

19. Governing Law and Disputes

If an amicable resolution cannot be reached, the dispute will be handled by the competent authorities or courts according to the applicable law.

Nothing in this section prevents a consumer from exercising any mandatory rights or protections granted by the laws applicable to them.
